If you’re Muslim, your estate will not be distributed according to Sharia law if you die without a will in Texas. Texas is a community property state which divides the family estate equally between a husband and wife. Unless the court decides that property is separate property, the state will automatically divided the estate 50/50 between the above mentioned parties. At the Law Offices of Garry L. According to Sharia law, upon the death of an individual 2/3rds of their estate is divided according to the Qur’an. In Muslim societies this is taken care of by the jurisdictional government. Islamic governments, following the Qur’an’s teachings, will divide the estate based on the principle outlined in the Qur’an. Since Texas history has been more influenced by a Judeo/Christian background, Sharia law is not followed. Texas does not follow any religious based distribution of the estate. Instead Texas has formed complex rules based on what it believes the majority of Texans would want to happen if they were to die without a will. It assumes, in most cases, that all children will receive the same amount. Texas courts do not recognize any religious exception for Muslims. In other words, the only way to guarantee that your estate will be distributed according to your beliefs is to have a Last Will and Testament written.
